BarkSeat respects the intellectual property rights of others and expects users to do the same. This policy explains how to report copyright infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512.

1. Reporting Copyright Infringement

If you believe content on BarkSeat infringes your copyright, send a written notice to us including all of the following:

1. A physical or electronic signature of the copyright owner or authorized agent
2. Identification of the copyrighted work claimed to have been infringed
3. Identification of the material claimed to be infringing, with the URL or sufficient detail to locate it on our site
4. Your contact information: name, address, telephone number, and email address
5. A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law
6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner

3. Counter-Notification

If your content was removed and you believe the removal was a mistake or misidentification, you may submit a counter-notification including:

1. Your physical or electronic signature
2. Identification of the material removed and the location it appeared before removal
3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification
4. Your name, address, and telephone number
5. A statement that you consent to the jurisdiction of the federal court in California (the location of our principal place of business) and that you will accept service of process from the person who provided the original notice

4. Repeat Infringers

BarkSeat will, in appropriate circumstances, terminate the accounts of users who are repeat infringers, in accordance with 17 U.S.C. §512(i).

5. Misrepresentation

Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages.
